Please read these Terms & Conditions (“Terms”) carefully before using humandesignshop.com (the “Site”) or purchasing products from Human Design Shop / Human Design Studios (“we”, “us”, “our”, “Human Design Shop”). By accessing or ordering from the Site you agree to be bound by these Terms. If you do not agree to all Terms, do not use the Site or purchase products.

1. Definitions

  • “Customer”, “You” means the person or entity placing an order through the Site or in person at one of our showrooms.
  • Products means any jewelry, components, gift cards, or services (including custom design and repairs) sold by Human Design Studios Fine Jewelry.
  • Custom or “made-to-order” means jewelry created or modified according to a customer’s specifications, including engravings and remounts.

2. Order Acceptance & Contract Formation

  • All orders placed on the Site are offers to purchase. Orders are subject to acceptance by Human Design Studios Fine Jewelry. We reserve the right to refuse or cancel any order for any reason, including product or pricing errors, inability to obtain authorization for payment, or suspected fraud.
  • You will receive an email confirmation when your order is accepted and processed; this email will constitute the formation of the contract between you and Human Design Studios Fine Jewelry.

3. Prices, Taxes & Payment

  • Prices shown on the Site are in USD unless otherwise indicated and do not include taxes, shipping, customs duties, or import taxes, which are your responsibility.
  • We accept payment via the methods displayed at checkout (credit/debit cards and third-party processors). Payment will be charged at time of purchase or as otherwise stated.
  • We strive for accuracy, but if a product is listed at an incorrect price due to typographical error or system error, we may cancel the order and refund any amount already paid.

4. Secure Checkout & Fraud Prevention

  • We use industry-standard security measures (SSL/TLS) to encrypt payment transactions and protect customer data. We may utilize third-party payment providers who independently manage card processing.
  • Orders may be subject to fraud screening. If we suspect fraud, we may place an order on hold and request additional verification documentation (ID, billing statement, or other proof) before fulfilling the order.

5. Shipping, Delivery & Title

  • Shipping methods, costs, and delivery estimates are displayed at checkout. Delivery times are estimates and may vary.
  • Title and risk of loss pass to you on delivery to the carrier. For high-value items we strongly recommend shipping with tracking and insurance.
  • For international orders, you are responsible for customs duties, VAT and any other import taxes.

6. Returns, Exchanges & Refunds

  • Ready-to-ship products may be eligible for return within the timeframe disclosed on the Returns page. Custom, personalized, engraved, or otherwise made-to-order products are generally final sale and not eligible for returns.

7. Custom Orders, Deposits & Cancellations

  • Custom and made-to-order items often require a deposit. Deposits are non-refundable once we begin work, stone procurement, or other irreversible steps. Specific deposit and cancellation terms will be identified in your order confirmation.
  • If you cancel a custom order prior to production beginning, any refund will be at our discretion and may be subject to deductions for materials and fees incurred.

8. Product Descriptions & Availability

  • We attempt to display product information accurately, including images and measurements, but colors may vary due to monitor settings and natural variations in gemstones. Minor variations and natural inclusions are not considered defects.
  • Product availability shown on the Site may change. When inventory is limited, we may only accept part of your order and will notify you of any shortages or cannot-fill situations.

9. Warranty, Repairs & Authenticity

  • We provide a limited workmanship warranty against manufacturing defects for the period described on the product page or warranty documentation. The warranty does not cover loss, theft, misuse, normal wear and tear, or damage from improper care.
  • We may offer repair, resizing, refurbishment, or upgrade services for a fee, or free under warranty if the issue is a covered defect. Contact [email protected] with photos and order details to initiate a claim.
  • For many products we provide a certificate of authenticity or gem report where applicable; details are noted on the relevant product page.

10. Intellectual Property

  • All content on the Site — including images, text, logos, designs, and software — is the intellectual property of Human Design Studios Fine Jewelry or its licensors and is protected by copyright, trademark and other laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

11. User Content, Reviews & Ratings

  • By submitting reviews, photos, or other user content to the Site or our social channels, you grant Human Design Studios Fine Jewelry a perpetual, non-exclusive, royalty-free license to use, reproduce, modify and publish that content in any media for promotional and commercial purposes, subject to our Privacy Policy.
  • Reviews must be honest and not defamatory. We reserve the right to edit or remove content that violates our guidelines.

12. Limitation of Liability & Disclaimer

  • To the fullest extent permitted by law, Human Design Shop’s liability for any claim arising from or related to your purchase is limited to the purchase price paid for the Product(s) at issue. We are not liable for indirect, incidental, special or consequential damages, including lost profits, loss of data or business interruption.
  • The Site, products, and services are provided “as is” and we disclaim all warranties not expressly set forth in these Terms.

13. Indemnification

  • You agree to indemnify and hold harmless Human Design Shop, its affiliates, officers, directors, employees and agents from any claim, loss, damage, liability or expense (including reasonable attorneys’ fees) arising out of (i) your use of the Site; (ii) your breach of these Terms; or (iii) your violation of any third-party rights.

14. Governing Law, Jurisdiction & Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of the State of Hawaii, without regard to conflict of laws rules. You agree that any dispute, claim or controversy arising out of or relating to these Terms or the Site shall be resolved in the state or federal courts located in Honolulu, Hawaii, and you consent to exclusive jurisdiction and venue there.
  • Before initiating formal legal action, you and Human Design Shop agree to attempt to resolve disputes informally by contacting [email protected]. We may also provide arbitration or alternative dispute resolution options in separate agreements.
